Kết quả chính của luận án:
Luận án đưa những phân tích
về hiệu lực của hợp đồng chia tài sản chung của vợ chồng trong thời kỳ hôn
nhân, các thành tố của lý luận nền tảng về hiệu lực của hợp đồng chia tài sản
chung của vợ chồng; đưa khái niệm gia đình phù hợp với đời sống xã hội hiện đại
và đầy đủ hơn đối với khái niệm chế độ hôn sản.
Luận án đã phân tích thêm
về mặt lý luận về sự cần thiết của hợp đồng chia tài sản chung của vợ chồng
trong thời kỳ hôn nhân; đưa ra định nghĩa phù hợp về hợp đồng chia tài sản
chung của vợ chồng trong thời kỳ hôn nhân;
Luận án đã đưa ra các
khuyến nghị về mặt khoa học pháp lý về hiệu lực của hợp đồng chia tài sản chung
của vợ chồng trong thời kỳ hôn nhân theo lý luận nền tảng về chủ thể của hợp
đồng chia tài sản chung của vợ chồng trong thời kỳ hôn nhân.
Ý nghĩa lý luận và thực tiễn của luận án:
Kết quả nghiên cứu của luận
án góp phần bổ sung những vấn đề lý luận về hiệu lực của hợp đồng chia tài sản
chung của vợ chồng trong thời kỳ hôn nhân ở Việt Nam.
Về thực tiễn, luận án là
tài liệu tham khảo để thiện chính sách, pháp luật về hiệu lực của hợp đồng chia
tài sản chung của vợ chồng trong thời kỳ hôn nhân. Luận án là tài liệu tham
khảo đối với sinh viên, học viên, nghiên cứu sinh, phục vụ cho công tác nghiên
cứu và giảng dạy về hiệu lực của hợp đồng chia tài sản chung của vợ chồng trong

tham khảo trong khoa học pháp lý, có thể tham khảo trong quá trình nghiên cứu,
giảng dạy, học tập tại Việt Nam.

Luận án có ý nghĩa thiết thực đối với hoạt động lập
pháp, hoạch định chính sách và xây dựng pháp luật về hiệu lực của hợp đồng chia
tài sản chung của vợ chồng trong thời kỳ hôn nhân.

Luận án đặt vấn đề là cơ sở để các công trình sau này

cho các vi phạm loại hợp đồng này.

Main results of the thesis:
The thesis analyzes the effect of the contract on common property division
between husband and wife during the marriage period, the elements of the basic theory on the effect
of the contract on common property division of husband and wife; brings the
concept of family suitable to modern social life and more fully for the concept
of the marriage property regime.
The thesis has further
analyzed theoretically about the necessity of a contract on common property
division of husband and wife during the marriage period; give an appropriate
definition of the contract on common property division between husband and wife
during the marriage period;
The thesis has given
scientific and legal recommendations on the effect of the contract on common property division
between husband and wife during the marriage period according to the fundamental theory of the subject
of the contract to divide common property of husband and wife. during the
marriage period.
Theoretical and practical significance of the thesis:
The research results of
the thesis contribute to additional theoretical issues about the effect of the contract on common property division
between husband and wife during the marriage period in Vietnam.
In practice, the thesis is
a reference to improve policies and laws on the effect of the contract on common property division
between husband and wife during the marriage period. The thesis is a reference for students, trainees
