Trên cơ sở tổng kết thực tiễn xây dựng pháp luật Việt Nam trong những năm qua, luận văn nêu khái quát những vấn đề lý luận về nhà nước pháp quyền, những quan điểm cơ bản về xây dựng Nhà nước pháp quyền Việt Nam XHCN; nghiên cứu đặc điểm của hệ thống pháp luật trong nhà nước pháp quyền; phân tích thực trạng đặc điểm của hệ thống pháp luật Việt Nam, nêu nguyên nhân thực trạng đó và đề xuất các giải pháp và phương hướng phát triển hệ thống pháp luật trong quá trình xây dựng Nhà nước pháp quyền Việt Nam XHCN.

Despite the efforts to develop the legal system in recent years, because of many different reasons, the Vietnam legal system hasn’t been complete, unified yet. Moreover, it could’nt satisfy the requirements of innovation and building the state jurisdiction.

Based on the litterature of pratices in buiding the legal system, the master’s thesis is oriented to study the theories of state jurisdiction: The principal standpoints of building the state jurisdiction in Socialiste Republic of Vietnam (SRV); the characteristics of legal system in the state jurisdiction; Analyzing the actual features of the Vietnam legal system; the reasons of the problems and proposing the directions to develop the Vietnam legal system in the process of building the SRV’s tate jurisdiction.

12. Pratical appicability, if any: This Master’s thesis could be used as a reference for people who do studing or teaching law, or ones who work in agencies of law building and legal protection, or law students.
