11. Tóm tắt các kết quả của luận văn:

Trên cơ sở phân tích một số vấn đề lý luận, thực trạng pháp luật và thực tiễn thi hành pháp luật về xử lý tài sản bảo đảm là bất động sản tại các tổ chức tín dụng Việt Nam, luận văn đã đạt được một số kết quả sau:

– Chỉ ra được đặc điểm của tài sản bảo đảm tiền vay là bất động sản và hoạt động xử lý tài sản bảo đảm tiền vay của các tổ chức tín dụng.

– Chỉ ra được những vướng mắc, bất cập, mâu thuẫn của các quy định pháp luật về tài sản bảo đảm và xử lý tài sản bảo đảm tiền vay là bất động sản hiện nay gây khó khăn cho hoạt động xử lý tài sản bảo đảm tiền vay là bất động sản của các tổ chức tín dụng.

– Đưa ra một số giải pháp tổng thể và kiến nghị cụ thể để hoàn thiện pháp luật về xử lý tài sản bảo đảm là bất động sản.

12. Khả năng ứng dụng trong thực tiễn: Đóng góp ý kiến cho việc sửa đổi BLDS năm 2005 và ban hành Luật Giao dịch bảo đảm, Luật Đăng ký giao dịch bảo đảm trong thời gian tới.

13. Những hướng nghiên cứu tiếp theo: Tiếp tục tham khảo quy định pháp luật của các quốc gia khác nhằm đưa ra những giải pháp hoàn thiện phù hợp với điều kiện kinh tế, xã hội của Việt Nam.

Based on the analysis of of some theoretical issues, the status of laws and law enforcement practices on the disposal of immovable loan security assets in the credit institutions of Vietnam, the thesis has achieved the following results:

– Indicate the characteristics of immovable loan security assets and the operations of the credit institutions on the disposal of immovable loan security assets.

– Indicate the problems, inadequacies, inconsistencies of the law on immovable loan security properties and the disposal of immovable loan security properties which make difficult for the disposal of immovable loan security properties of the Vietnam credit institutions

– Give some general solutions and specific recommendations for improving the law on the disposal of immovable loan security assets.

12. Pratical appicability, if any:

To Feedback for the amendment of the Civil Code 2005 and the promulgation of secured transaction law, the law on registration of security transactions in the future.

Tiếp tục tham khảo quy định pháp luật của các quốc gia khác nhằm đưa ra những giải pháp hoàn thiện phù hợp với điều kiện kinh tế, xã hội của Việt Nam.
