11. Tóm tắt các kết quả của luận văn:

– Nghiên cứu, khái quát một số cơ sở lý luận về về tài sản, quyền sở hữu và xác lập quyền sở hữu theo thời hiệu trong pháp luật Việt Nam.

– Nghiên cứu, phân tích và đánh giá thực trạng áp dụng quy định xác lập quyền sở hữu theo thời hiệu ở Việt nam hiện nay, đánh giá những khó khăn, bất cập trong việc áp dụng pháp luật Việt Nam về xác lập quyền sở hữu theo thời hiệu, nguyên nhân và hậu quả của những khó khăn bất cập đó.

– Bằng những lập luận, phân tích khoa học, tác giả đề xuất, kiến nghị các giải pháp chủ yếu để hoàn thiện quy định pháp luật Việt Nam nói chung và Bộ luật dân sự nói riêng về xác lập quyền sở hữu theo thời hiệu.

 Điểm mới:

– Những phân tích của đề tài làm rõ cơ sở lý luận về xác lập quyền sở hữu theo thời hiệu.

– Chỉ rõ thực trạng áp dụng các quy định của pháp luật để giải quyết các quan hệ xã hội liên quan đến xác lập quyền sở hữu theo thời hiệu, những khó khăn và bất cập. Đưa ra một số quan điểm, giải pháp góp phần hoàn thiện các quy định pháp luật Việt Nam về xác lập quyền sở hữu theo thời hiệu.

12. Khả năng ứng dụng trong thực tiễn: Góp phần hoàn thiện quy định pháp luật Việt Nam. Đóng góp ý kiến vào quá trình xây dựng và hoàn thiện pháp luật Việt Nam về xác lập quyền sở hữu theo thời hiệu. Là tài liệu tham khảo cho học tập, giảng dạy và nghiên cứu về quyền sở hưu và xác lập quyền sở hữu và là tài liệu có tính chất tham khảo cho các cơ quan nhà nước trong việc hoàn thiện hệ thống pháp luật Việt Nam.

11. Summary of the findings of the thesis:

– Research, generalizations about some theoretical basis of property, ownership and establishment of property rights according to the statute of limitations in Vietnamese law.

– Research, analysis and evaluating of the present situation of application about regulations establishment of property rights according to the statute of limitations in Vietnam, assessing the difficulties and inadequacies in the application of the law of Vietnam about legal regulations for establishment of property rights according to the statute of limitations, the causes and consequences of these difficulties and inadequacies.

– By these arguments, scientific analysis, the proposal student, petition primarily solutions to finalize the laws and regulations of Vietnam in general and Civil Code in particular about establishing property rights according to the statute of limitations.

The new point:

 – The analysis of the subject to clarify theoretical basis about establishment of property rights according to the statute of limitations.

Specify the status of the application of laws and regulations to solve the social relations involving for establishment of property rights according to the statute of limitations, the difficulties and inadequacies. Give some perspectives, solutions to contribute to perfecting the legal regulations of Vietnam on the establishment of property rights according to the statute of limitations.

Give comments on the process of developing and perfecting the legislation of Vietnam on the establishment of property rights according to the statute of limitations. That is the reference for studying, teaching and researching about ownership and establishment of property rights, is reference documents for the state agencies in finalizing the legal system of Vietnam as well.
