11. Tóm tắt các kết quả mới của luận án

– nghiên cứu một số vấn đề lý luận cơ bản về đăng ký quốc tế nhãn hiệu như khái niệm đăng ký nhãn hiệu, đăng ký quốc tế; đặc điểm điều chỉnh pháp lý về hệ thống đăng ký quốc tế nhãn hiệu (điều ước quốc tế, pháp luật quốc gia, mối quan hệ giữa pháp luật quốc tế và pháp luật quốc gia); hiệu quả của việc sử dụng hệ thống Madrid; các yếu tố bảo đảm và tiêu chí đánh giá việc sử dụng hiệu quả hệ thống Madrid; và xu hướng phát triển của hệ thống Madrid;

– khái quát xu hướng gia nhập hệ thống; nghiên cứu và đánh giá thực tiễn sử dụng hệ thống tại một số thành viên của hệ thống như Hoa Kỳ, Liên minh châu Âu, Trung Quốc, Nhật Bản và Việt Nam; làm rõ các rào cản đối với việc sử dụng hiệu quả hệ thống Madrid.

– phân tích nhu cầu nâng cao hiệu quả hệ thống Madrid nhằm tạo thuận lợi cho người sử dụng và đáp ứng yêu cầu hội nhập và thực thi cam kết trong các điều ước quốc tế;

– đề xuất các khuyến nghị hoàn thiện và kiện toàn hệ thống, cụ thể là: các khuyến nghị hoàn thiện pháp luật quốc gia, pháp luật quốc tế; các giải pháp nâng cao chất lượng hoạt động của các cơ quan thực thi như văn phòng quốc tế, cơ quan đăng ký quốc gia; các cơ quan thực thi khác; các giải pháp khuyến khích nâng cao hiệu quả sử dụng từ phía người nộp đơn/chủ sở hữu và luật sư/đại diện chủ thể quyền và các tổ chức xã hội nghề nghiệp.

12. Khả năng ứng dụng trong thực tiễn. Luận án góp phần xây dựng, hoàn thiện cơ sở lý luận và hoàn thiện pháp luật về đăng ký quốc tế nhãn hiệu, đồng thời, cung cấp những thông tin, kiến thức hữu ích cho người sử dụng hệ thống để áp dụng pháp luật và sử dụng hiệu quả hệ thống Madrid. Luận án có thể sử dụng làm tài liệu tham khảo để xây dựng, hoạch định chính sách và pháp luật; thực thi bảo hộ quyền SHTT; nghiên cứu, giảng dạy và áp dụng pháp luật.

11. Summary of the new findings of the thesis:

– Study and clarify some principal theoretical issues on the international registration of marks, such as the concept of trademark registration, international registration; characteristics of legal regulations on the international registration (international treaties, national legislations, relationship between international law and national law); effectiveness of the using Madrid system; key factors for effective use of the Madrid system and tendency for development of the Madrid system;

– study on the tendency for accession into the system; practical application of law on the international registration of marks in several members such as United States of America, European Union, China, Japan and Vietnam; analyze difficulties and obstacles of the effective use of the Madrid system; the need for completion of the law and enhance the effectiveness of the Madrid system for satisfaction of the users and harmonization of the integration requirement; (iv) suggest recommendation for legal improvement and appropriate measures for enhancing the effectiveness of the Madrid system.

– analyze the need for enhancing the effective use of the Madrid system for satisfaction of the users and harmonization of the integration requirements as well as for implementation of the commitments in the international treaties;

– suggest recommendations for completion and improvement of the Madrid system, including recommendations for improvement of the international law and national legislation, appropriate measures for enhancing quality of the implementation agencies such as international bureau, national registration office, other enforcement agencies; recommendations for encouraging effective use of the system by the applicants/right holders; lawyers/IP agents and professional social institutions.

12. Practical applicability: This study makes a contribution into the establishment and completion of the theoretical basis and practical law on the international registration of mark; provide the users with necessary information and knowledge for law application and effective use of the Madrid system. It is used as good reference document for elaborating and making policy and legal regulations; for implementing and enforcing law for protection of intellectual property; studying, teaching and applying legal regulations in the practice.
