11. Tóm tắt các kết quả của luận văn:
Mục tiêu tổng quát của việc nghiên cứu đề tài: “Tư tưởng pháp quyền, dân chủ Hồ Chí Minh trong Tuyên Ngôn độc lập, Hiến pháp 1946 và những giá trị kế thừa” sẽ làm cở sở lí luận cho các nhà quản lí nhà nước. Từ đó hoạch định đề ra các phương hướng, biện pháp giải quyết, hoàn thiện hiến pháp ở nước ta trong giai đoạn hiện nay theo mục tiêu xây dựng nhà nước của dân do dân và vì dân, đảm bảo người dân là chủ của đất nước.
Trên cơ sở của mục tiêu tổng quát, trong quá trình nghiên cứu đề tài cần đạt được những mục tiêu cụ thể sau đây:
– Cần làm rõ những nội dung cơ bản nhất trong Tuyên ngôn Độc lập và Hiến pháp năm 1946 thể hiện tư tưởng pháp quyền, dân chủ của Hồ Chí Minh.
– So sánh với lý luận chung về nhà nước pháp quyền, dân chủ ở các nước trên thế giới.
– Trên sở so sánh đó để tìm ra những giá trị đã kết tinh trong Tuyên ngôn Độc lập và Hiến pháp 1946 thể hiện tư tưởng pháp quyền Hồ Chí Minh. Từ đó rút ra những giá trị kế thừa mà nhà nước ta cần phải tiếp thu và phát triển trong quá trình xây dựng nhà nước pháp quyền ở Việt Nam trong giai đoạn hiện nay.
Pháp quyền, dân chủ là tư tưởng không phải mới mẻ trên thế giới. Đối với Việt Nam thì tư tưởng pháp quyền, dân chủ đã được Hồ Chủ Tịch tiếp thu các giá trị tư tưởng tiến bộ trên thế giới rồi Người kết tinh những giá trị đó trong Tuyên ngôn độc lập và Hiến pháp năm 1946. Mặc dù đã qua gần 70 năm, thực tiễn cũng đã có nhiều tác giả, tác phẩm đã nghiên cứu đề tài này ở nhiều phương diện, khía cạnh và cấp độ khác nhau. Nhưng cho đến nay vẫn chưa có một tác giả và một công trình khoa học nào nghiên cứu một cách đầy đủ và toàn diện về đề tài này. Chính vì vậy đề tài “Tư tưởng pháp quyền, dân chủ Hồ Chí Minh trong Tuyên Ngôn độc lập, Hiến pháp 1946 và những giá trị kế thừa” vẫn còn được tiếp tục nghiên cứu và hoàn thiện cả về mặt lí luận và thực tiễn. Đặc biệt hiện nay công cuộc sửa đổi hiến pháp lại càng cần thiết phải có những công trình nghiên cứu những giá trị tư tưởng pháp quyền dân chủ của Hồ Chủ Tịch trong Tuyên ngôn Độc lập và Hiến pháp 1946 làm cơ sở lý luận để vận dụng, kế thừa những giá trị đó.

Khả năng ứng dụng trong thực tiễn: Hi vọng rằng Luận văn sẽ là tài liệu tham khảo phục vụ cho hoạt động nghiên cứu, lý luận của các luật gia, đồng thời sẽ là tài liệu tham khảo phục vụ cho việc học tập, giảng dạy và nghiên cứu khoa học tại các cơ sở đào tạo luật ở Việt Nam về giá trị kế thừa của tư tưởng pháp quyền, dân chủ của Hồ Chí Minh trong Tuyên ngôn độc lập và Hiến pháp 1946.

The overall objective of the research thesis: “Ideology the rule of law and democracy in Ho Chi Minh City in the Declaration of Independence, the Constitution of 1946 and values inherited” will make theoretical basis for the state managers. Since then plan out the directions and solutions, perfect constitution in our country in the current period in accordance with the objective of building a government of the people by the people and for the people, to ensure that all people of the country.
On the basis of the overall goal, in the process of research thesis to achieve the following specific objectives:
– Need to clarify the basic content of the Declaration of Independence and the Constitution of 1946 reflected ideological rule of law and democracy in Ho Chi Minh City.
– Compared with the general theory of the rule of law and democracy in countries around the world.
– On the basis of this comparison in order to crystallize value in the Declaration of Independence and the Constitution of 1946 expressed thoughts of Ho Chi Minh law. From which to draw valuable legacy that our state needs to acquire and develop in the process of building the rule of law in Vietnam in the current period.
Rule of law, democracy is not a new idea in the world. For Vietnam, the idea of law, democracy was President Ho Chi Minh Acquisition of progressive values in the world and who crystallized the values in the Declaration of Independence in 1945 and the 1946 Constitution. Despite nearly 70 years, the practice also has multiple authors, the research work has been the subject of many aspects, aspects and different levels. But so far there is no author, and a scientific research process fully and comprehensively on the subject. So the thesis “Ideology the rule of law and democracy in Ho Chi Minh City in the Declaration of Independence, the Constitution of 1946 and values inherited” still continue to study and complete both reasonable theory and practice. Especially now the work of the constitutional amendments as necessary to the study of the ideological values of the democratic rule of law President Ho Chi Minh in the Declaration of Independence and the Constitution of 1946 as a theoretical basis for advocacy the inheritance of those values.

Pratical appicability, if any: Hopefully thesis reference will be served for research activities, the lawyers argued, and references will be served for learning, teaching and scientific research in the legal institutions in Vietnam about the value of ideas inherited the rule of law, democracy, Ho Chi Minh’s Declaration of Independence and the 1946 Constitution.
