11. Tóm tắt các kết quả mới của luận án:
Là công trình khoa học đầu tiên nghiên cứu một cách chuyên sâu, có hệ thống và toàn diện các vấn đề lý luận, thực tiễn quy định và thực hiện pháp luật về đấu giá tài sản công ở Việt Nam, luận án có những đóng góp mới chủ yếu sau đây:
11.1. Luận án đã đề xuất xây dựng mô hình đấu giá tài sản công hoàn toàn mới tại Việt Nam nhằm bảo toàn và hướng tới giá trị gia tăng của tài sản công đưa ra đấu giá, hạn chế tình trạng thông đồng, trục lợi, thất thoát tài sản công : mô hình đấu giá tăng dần có bảo lưu;
11.2. Luận án đã đề xuất sửa đổi, bổ sung các quy định của Luật đấu giá tài sản về đấu giá tài sản công cho phù hợp với mô hình đấu giá tăng dần có bảo lưu, thông lệ quốc tế và thực tiễn tại Việt Nam, như: sửa đổi, bổ sung quy định về tổ chức đấu giá tài sản thực hiện việc đấu giá tài sản công và việc lựa chọn tổ chức đấu giá tài sản công; sửa đổi, bổ sung việc định giá tài sản công đưa ra đấu giá (xác định giá khởi điểm, giá bảo lưu); sửa đổi quy định về công bố thông tin, tổ chức đăng ký tham gia đấu giá, tổ chức cuộc đấu giá tài sản công, xác định đấu giá tài sản công không thành;
11.3. Luận án đã đề xuất chỉnh sửa các quy định của Luật đấu giá tài sản về giao kết hợp đồng trong đấu giá tài sản công, cụ thể: (1) Xác định lại đề nghị và chấp nhận đề nghị giao kết hợp đồng trong đấu giá tăng dần phù hợp với lý luận về đấu giá tăng dần và lý thuyết về hợp đồng, từ đó đề xuất sửa đổi khoản 3 Điều 46 Luật đấu giá tài sản cho phù hợp; (2) xác định thời điểm giao kết hợp đồng trong đấu giá tăng dần dựa trên lý thuyết hợp đồng và kinh nghiệm của một số quốc gia trên thế giới, từ đó đề xuất bổ sung quy định về thời điểm giao kết hợp đồng trong đấu giá tăng dần và kiến nghị sửa đổi khoản 3 Điều 44 và khoản 3 Điều 46 Luật đấu giá tài sản cho phù hợp; (3) kiến nghị sửa đổi, bổ sung quy định về chế tài xử lý vi phạm trong trường hợp người trúng đấu giá từ chối ký biên bản đấu giá và trường hợp từ chối kết quả đấu giá theo hướng xác định và xử lý theo vi phạm hợp đồng;
11.4. Luận án đã đề xuất sửa đổi, bổ sung một số quy định chung của pháp luật đấu giá tài sản, như: sửa đổi bổ sung quy định về bước giá, về thù lao dịch vụ, chi phí đấu giá tài sản, v.v.
12. Khả năng ứng dụng trong thực tiễn:
12.1. Với các kết quả nghiên cứu đạt được, luận án góp phần xây dựng lý luận chuyên sâu, toàn diện và hệ thống về đấu giá tài sản công và pháp luật về đấu giá tài sản công ở Việt Nam. Do vậy, luận án là tài liệu tham khảo trong nghiên cứu, giảng dạy, học tập tại Việt Nam;
12.2. Luận án làm sáng tỏ những vấn đề pháp lý, những bất cập, tồn tại; từ đó đưa ra những giải pháp sửa đổi, bổ sung hoàn thiện pháp luật về đấu giá tài sản công ở Việt Nam. Những kết luận, kiến nghị của luận án có giá trị tham khảo trong quá trình hoàn thiện chính sách, pháp luật về đấu giá tài sản công ở Việt Nam. Luận án còn là tài liệu tham khảo hữu ích đối với các tổ chức đấu giá tài sản, các đấu giá viên đang hành nghề.

11. Summary of the new findings of the thesis:
As the first scientific work to study in-depth, systematically and comprehensively the theoretical and practical issues of regulation and implementation of the law on public property auction in Vietnam, the thesis has the following major new contributions:
11.1. The thesis has proposed to build a completely new public property auction model in Vietnam in order to preserve and aim for the added value of public properties put up for auction, to limit collusion, profiteering, and loss of money: ascending auction model with reservation;
11.2. The thesis has proposed to amend and supplement the provisions of the Law on Property Auction on public property auction to be suitable with the ascending auction model with reservations, international conventions and practices in Vietnam, such as: amending and supplementing regulations on asset auction organizations conducting public asset auctions and the selection of public asset auction organizations; amending and supplementing the valuation of public properties put up for auction (determining the starting price and reserve price); amending regulations on information disclosure, organization of registration for participation in auctions, operation of public property auctions, determination of unsuccessful public asset auctions;
11.3. The thesis has proposed to modify the provisions of the Law on Property Auction on contract entering in public asset auction, specifically: (1) Redefining the offer and accepting the offer to enter into a contract in the ascending auction in accordance with the theory of ascending auction and the theory of contract, thereby proposing amendments to Clause 3, Article 46 of the Law on Property Auction; (2) Determining the time to conclude the contract in the ascending auction based on the contract theory and experience of some countries in the world, thereby proposing to supplement regulations on the time of entering into the contract in ascending auctions and propose amendments to Clause 3, Article 44 and Clause 3, Article 46 of the Law on Property Auction accordingly; (3)
Proposing amendments and supplements to regulations on sanctions for handling violations in case the auction winner refuses to sign the auction minutes and in case the auction result is rejected in the direction of determination and handling according to contract violation;
11.4. The thesis has proposed amending and supplementing a number of general provisions of the law on property auction, such as: amending and supplementing regulations on price steps, service remuneration, property auction costs, etc.
12. Practical applicability:
12.1. With the obtained research results, the thesis contributes to building an in-depth, comprehensive and systematic theory on public property auction and the law on public property auction in Vietnam. Therefore, the thesis is qualified to become a reference in research, teaching and learning in Vietnam;
12.2. The thesis clarifies legal issues, existing inadequacies; thereby offering solutions to amend and supplement the law on public property auction in Vietnam. The conclusions and recommendations of the thesis are of reference value in the process of completing policies and laws on public property auction in Vietnam. The thesis is also a useful reference for property auction organizations and working auctioneers.
